Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern access to and use of the CafeSuite web application and related websites (the “Service”). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if you create or join an organization, that organization.

If you do not agree, do not use the Service. If you use CafeSuite on behalf of a business, you represent that you have authority to bind that business.

2. The Service

CafeSuite is software for managing timed sessions, customer accounts, reservations, shop sales, and related operations in shared venues (for example internet cafés, gaming rooms, booths, and similar spaces).

The Service is provided as a hosted web application. Features may change as we develop the product. An early or invited release may be incomplete, and we may add, modify, or withdraw functionality.

3. Accounts and staff access

You must provide accurate information when you register and keep your credentials confidential. You are responsible for activity under your staff accounts, including operators you invite.

Organization owners and admins control roles, location access, and permissions. You must ensure that only authorized staff use the Service and that you have a lawful basis to create accounts for them.

4. Your venue content

You retain rights to the data you (and your staff) submit: locations, stations, customer accounts, sessions, reservations, sales, and similar operational records (“Venue Data”).

You grant CafeSuite a limited licence to host, process, and display Venue Data solely to provide the Service to your organization, including backups and security. You are responsible for the lawfulness of Venue Data, including personal data of your venue’s customers and staff.

5. Acceptable use

You may not: (a) misuse the Service or attempt unauthorized access; (b) interfere with other customers or infrastructure; (c) use the Service for unlawful activity; (d) upload malware or scrape the Service except through documented APIs you are permitted to use; or (e) resell the Service without our written consent.

We may suspend access if we reasonably believe these Terms are being violated or if use poses a security or legal risk.

6. Plans, trials, and fees

The Service may be offered free of charge, as a trial, or under a paid subscription. If paid plans apply, fees, taxes, and billing terms will be shown at purchase or in an order form.

Unless stated otherwise, subscriptions renew until cancelled. You remain responsible for taxes applicable to your purchases. We may change prices with notice before the next billing period.

7. Availability and support

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation, especially during an early release. Scheduled or emergency maintenance may occur.

Support, if offered, is provided on a reasonable-efforts basis unless a separate written agreement says otherwise.

8. Intellectual property

CafeSuite, including software, design, and trademarks, remains our property or that of our licensors. These Terms do not transfer ownership of the Service to you.

Feedback you send may be used to improve the Service without obligation to you.

9. Disclaimers and liability

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, CafeSuite and its operators are not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of Venue Data, arising from use of the Service. Our aggregate liability for claims relating to the Service is limited to the fees you paid us for the Service in the 12 months before the claim, or EUR 100 if you paid nothing.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

10. Term and termination

You may stop using the Service at any time. Organization owners may request deletion of their workspace by contacting us.

We may suspend or terminate access for material breach, non-payment, legal risk, or if we discontinue the Service, with reasonable notice where practicable. After termination, we may delete or anonymize Venue Data after a short retention period except where law requires otherwise.

11. Governing law

These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-law rules. Courts in Poland have exclusive jurisdiction, except that we may seek injunctive relief in any venue to protect intellectual property or confidential information.

If you are a consumer with mandatory rights in your country of residence, those rights remain unaffected.

12. Changes

We may update these Terms. The effective date at the top of this page will change. Material changes will be indicated in the product or by email where we have a contact address. Continued use after the new effective date constitutes acceptance of the updated Terms.
